ANC6A to consider Joe Englert request to allow late night patio hours Tuesday, Dec 17, 7 pm @ Maury Elem (1250 Constitution Ave NE)

Joe Englert has petitioned to have the voluntary agreements that he entered into with ANC6A when he first opened a series of venues along H Street eliminated.  As part of his request, Englert is complaining that establishments that have patios on public space or rooftop decks are required to close those outdoor areas prior to last call in order to reduce the late night noise that impacts their nearby neighbors.  Englert's request to eliminate the restricted hours for the outdoor spaces will be heard by ANC6A this Tuesday, December 17, 7 pm at Maury Elementary School (1250 Constitution Ave NE).  If you have views on this issue, you should plan to attend and communicate them to your ANC Commissioner as well.

At the meeting, there will also be an update regarding Ben's Chili Bowl who has refused to sign the agreement that every other liquor serving establishment on H Street has signed, thus forcing the ANC to protest their license application.  A note from the ANC's Alcohol Committee chair and the meeting agenda follow.

Hello ANC 6A Community,
Attached and pasted below is the agenda for the next ANC 6A Alcoholic Beverage Licensing (ABL) Committee meeting.  The meeting will be held on Tuesday, December 17, 2013 at 7pm at Maury Elementary School (1250 Constitution Avenue NE).  Note that this is not the normal location.
The majority of this meeting will be devoted to discussing the ANC's stance on closing hours for public space patios and rooftop decks of restaurants and bars in ANC 6A.  The ANC currently asks establishments to agree to close their public space patios and rooftop decks at 11pm on weeknights and 12am on weekends.  There have been many requests for the ANC to revisit this policy, so the ABL Committee will take it up at this meeting with the goal of making a recommendation to the ANC.
If you are interested in any way in this issue, please make every effort to attend.  We want to hear from all stakeholders - both neighbors and business owners, and can only get a good gauge on the issue if we have good attendance at the meeting.  Please don't hesitate to contact me if you have any questions or concerns.
I will circulate any updates to the agenda on these listserves, and updates will also be posted to ANC6A.org.
Thanks,
Jay Williams

  1. Talk about being a bad neighbor (I mean the ANC). The way you phrase the whole thing kind of give away your bias - they refuse to do what everyone else does! The hand of the ANC is being forced to protest! Those sneaky Ben's Chili Bowl people - we're being forced to force them to sign a piece of paper and its all their fault!

While I don't disagree on facts, it is also true that Ben's Chili Bowl is refusing to sign an agreement that hasn't been updated in 5 years, that adds extra regulations above and beyond standard DC law, that potentially exposes them to double jeopardy and that every other place on H Street would like to have revised or removed completely.

Those wacky business owners! How dare they try to represent their interests. Doesn't Ben know he needs to agree to whatever the ANC says in order to join our neighborhood?

Is anyone else starting to think the problem is the VA and a few members on the ANC instead of Ben's Chili Bowl (and every other biz on H)?
